Declaration to be placed on the Pension list, under the Act of the 18th March 1818—

Superior Court of Law Term of the 3rd Monday after the fourth Monday of September 1827

On this 18th day of October 1827 personally appeared in open court being a Court of Record for the County of Rutherford John Jenkins resident in the said county, aged seventy three years, who being first duly Sworn according to Law, doth on his oath, make the following declaration, in order to obtain the provisions made by the acts of Congress, of the 18th March 1818 and 1st May 1820 that he the said John Jenkins enlisted for the Term of 18 months, on, or about the last of the Summer or 1st of the fall of the year 1776, or about that time, (but as to the time he cannot say posatively as his memory fails him) in the State of South Carolina, in the company commanded by Captain Francis Boykin in the Regiment commanded by Colonel William Thompson, being the 3rd Regiment in the line of the State of South Carolina, on the South Carolina Continental establishment; That he continued to Serve in the said Company 1st as private and then a Sergeant for the Term of 18 months, when he was discharged from the Service at the Ten mile house between Charleston and Fairfield in the State of South Carolina; That he was at the seige of Fort Moultre when Sir Peter Parker cannonaded it, that he served better than 9 months of that time in said company a first Sergeant and was discharged as such.

That he hereby relinquishes every claim whatever to a pension, except the present that his name is not on the Roll of any State, except South Carolina, and that he has not known untill he made an endeavor to provide himself with evidence to support this application, that he was entitled to a pension. That he is very poor and infirm and lives with his son who takes care of him and his wife—an old woman, about the same age of himself. That he has depended upon his son aforesaid for his support and maintainance for upwards of twenty years, that he has no property but his wearing apparel.

And in pursuance of the act of the 1st of May 1820, I do solemly swear, that I was a resident citizen of the united States on the 18th day of March 1818, that I have not since that time by gift, sale, or in any manner disposed of my property, or any part thereof, with intent thereby so to diminish it as to bring myself within the provisions of an act of Congress, entitled an act to provide for certain persons engaged in the Land and Naval Service of the United States in the Revolutionary war, passed on the 18th March 1818, and that I have not, nor has any person in my trust for me, any property, or securities, contracts or debts due to me, nor have I any income, other than my wearing apparel. I James Morris Clerk of the Superior Court of Law for the County of Rutherford do hereby certify that it appears to the satisfaction of the court, that the said John Jenkins did serve in the Revolutionary war for the term of nine months under one engagement, in the continental establishment. I do further certify, that the foregoing oath and the statement therein contained are truly copied from the Records of the Said Court, and I do further certify, that it is the opinion of the said Court that the said John Jenkins is worth nothing
