Order for carrying into Execution the 74th Art. of Governor Dobb's Instructions—

 

 

 

Whereas His Majesty was pleased sometime since, to referr unto the Consideration of a Committee of the Lords of the Privy Council an Extract of a Letter from Arthur Dobbs Esqr. Governor of the Province of North Carolina, submitting whether it might not be for the Benefit of the Revenue of His Majesty's Quit Rents, That an Alteration should be made in the Seventy fourth Article of His Majesty's Instructions to the said Governor, by which, he is directed to seize as escheated all such Parts of Lands granted by His late Majesty to Murray Crimble and James Huey and their Associates as are not actually settled according to the Condition of their Grants, and that instead of escheating all such Lands as are not actually settled, the Associates should be charged with Quit Rents only for such Lands as they have or should from time to time dispose of or settle, which they have been prevented from doing during the Course of the War—And Whereas the said Lords and said Committee of Council have this day Reported to His Majesty that they have considered thereof, and received the opinion of the Lords Commissioners for Trade and Plantations thereupon. And in regard the War with the Cherokee Indians has long since ceased, and that by the happy Conclusion of Peace with France every Circumstance which operated to distress the Planter and retard the Settlement is now at an End, there did not seem to be any reason for making the Alteration proposed by Mr. Dobbs, and were therefore of opinion that the said Article might now be carried into Execution without prejudice to His Majesty's Quit Rents or Hardships to the Grantees. His Majesty in Council Approving thereof is hereby pleased to order that the aforesaid seventy fourth Article of Instructions given to the Governors of North Carolina. Be carried into Execution and not delay'd upon any Pretence whatsoever—Whereof the said Governor, or the Governor or Commander in Chief of His Majesty's said Province for the time being, and all others whom it may concern, are to take notice and Govern themselves accordingly.
