Dear Sir:-

Replying to the letter of your Sec'y, Mr. Kerr, dated Aug. 4th, I want to say that I believe the attorney general is in error as to his ruling in the matter of members of Boards of Directors of State Institutions serving in the Legislature. I remember that I read not long ago a judgment of the Supreme Court which said that a director of a State Institution is an officer within the meaning of the Constitution. I also know that Gov. Glenn so held, also Gov. Aycock. The law passed at the last session of the Legislature has reference I think only to the state institutions for girls. Any way the Legislature cannot change the Constitution.
