You and every of you as a Court according to Act of Assembly of this province for Tryal of Slaves shall well & truly try Rose a Negro ^Woman^ Slave belonging ^belonging to Matthew Rabourn^ concerning such Crimes as shall be Exhibitted against her and a true Judgment give according to Evidence
So help you God
The above person's being sworn having Taken the above Oath in presence of Montfort Eelbeck Esqr. the Court was thereupon Open'd by Proclamation made in due form Thereupon Rose the prisoner, a Negro Woman Slave the property of Mathew Raburn, was charg'd with Burning the Barn ^with a Quantity of Corn & Wheat therein, the property^ of John Bradford Esqr. of this County: to support the Charge, Malachi Murden Esqr. being first sworn as a Witness, saith, that soon after the sd. Barn was Burn'd the prisoner was brot. before him ^on suspission of committing sd. fact,^ to be examin'd thereof, & that without any threats or coertion, she there voluntarily confess'd to him that she did put fire in the said Barn amongst some Corn Shucks;
John Bradford Esqr. also sworn, says she confess'd to him she actually did Burn his Barn, for having instigated her Master formerly to whip her, for some Crime—
Archibald Hamilton also sworn, saith the Prisoner confess'd to him yesterday: to the same purpose.
Gust, a Negro man Slave, property of Thomas Motley being caution'd according to Act of Assembly for Qualifyg Negro Witnesses, saith that the prisoner told him the Saturday before the sd. Barn was burn'd, that the next time she Run away, she wou'd burn some of their Houses over their heads.
Luke a Negro Boy, property of Jane Ferguson charg'd as aforesd. saith the prisoner told him that if her Master whip'd her & burn'd her Cloaths as he had said he wou'd, She wou'd burn his House over his Head & then kill herself
Willa. Barksdale, sworn, saith, he talk'd with the prisoner about the Burning the sd. Barn, & she Confess'd to him very fully that She did Burn the said Barn, with all the Circumstances relating to it.
The Court taking the whole Matters into Mature Consideration; do Adjudge & Ad That the said Negro woman, Slave, nam'd Rose, the property of Mathew Raburn, is Guilty of The Felony, wherewith she was ^stands^ Charg'd in Burning the Barn, with the Corn therein of John Bradford Esqr. & that forthe said Negro woman Rose be, for the said Crime, be Hang's by the Neck, untill she be dead: and that the Sheriff of Halifax, cause Execution to be done therein, on Saturday next the 6th. Instant, betwixt the Hours of 12 & 3 of the Clock in the Afternoon.
