Declaration of John Clark

In order to obtain the benefit of the third section of the act of Congress of the 4th July 1836 and the Joint resolution of July 7th 1838 granting pensions to certain widows 

On this 9th day of May 1845 Personally appeared before the Worshiple County Court now sitting Mr John Clark a residant of the County and State aforesaid aged Forty six years ^in June next^ and after first being ^duly^ sworn according to law doth on this oath make the following declaration in order to obtain the benefit of the third section of the act of Congress of the 4th July 1836 that he is the Son of Wm Clark who was a Captain in the North Carolina line in the war of the Revolution for the particulars of service he refers the department to the testimony hereunto annexed he further declares that his Father the aforesaid Wm Clark died on the 21st day of July Eighteen hundred and thirty Six declarent often urged his father the aforesaid Wm Clark to apply for a pension when a live but owing to his having attached himself to the persuasion of friends he refused his father the aforesaid Wm Clark died as above stated viz on the 21st day of July 1836 leaving a widow Elender Clark Who departed this on the 5th day of June Eighteen hundred and thirty nine this declaration is made to obtain the pension due the widow at the time of her death under the act of Congress of July 4th 1836 he further declares that his mother the aforesaid Elender Clark died as above stated Leaving the following named child^ren^ viz Dugan Clark Alexander Clark Thomas Clark Mary Clark now Mary Jones Maragret Clark now Maragret Henley Haner Clark now Haner Davis and Declarent only heirs at law Declarent refers the department to the famley Record of the births of the Clibren born to the aforesaid Wm and Elender Clark kept by his father the aforesaid Wm Clark in his own proper hand wrighting withe the exceptions of the second colum on the first page and that Contains the births of declarents Brother Dugan Clarks Chidren and that the marriage took place before the termination of her husubands last service

We, Hugh McCain ^A. H. March^ and Enoch Byrns residing in the Caunty of Randalph and state of North Carolina hereby cirtify that ^we^ are well acquainted with John Clark who has sworn to the forgaing declaration that we beleive him to the son of Wm. Clark a Captain in the War of the revolution that ^he^ is reputed in the neighbourhood where he resides and we concur in that opinon sworn to and subscribed the day and year aforesaid

And the said Caurt do herdey declaer their opinion after the investigation of the matter that the above named Applicant in the son and one of the heirs at law of the above named Wm. Clark and Elender Clark and the Caurt further cirtify that the aforesaid Elender Clark died on the 5th day of June 1839 leaving the following named Children only heirs at Law viz Dugan Clark Alexander Clark Thomas Clark Mary Clark now Mary Jones Maragret Clark now Maragret Henley Haner Clark now Haner Davis and declarent John Clark and the Caurt further certify that Hugh McCain ^A. H. Marsh^ and Enoch Byrns whoes names are signed to the proceeding Cirtificate reside in the County of Randolph State of North Carolina that they are respectable and are intiled to eredit

I Hugh McCain Clerk of the County Called of Randolph County do hereby Certify that the foregoing proceedings are the original proceedings had and approved of by the County Court at its May Term 1845 relative to the declaration of John Clark one of the hiers of William and Elender Clark to obtain the Benefit of the acts of Congress in relation to Revolutionary Pensions—

I further Certify that I Cut out of a Bible the of William & Elender Clarks children and also the Place where the said William Clark had written his name in after Purchasing said Bible, all three of said leaves are here attached

In Testimony whereof I have hereunto set my hand and affixed the seal of the said Caurt at office in Ashboro this 13th of May AD 1845

Elliott chairman of the County Court of Randolph County do hereby certify that Hugh McCain whose name appears to the forgoing Certificate, was at the time of signing the same, & now is Clerk of the County Court of Randolph County, & that full faith and credit are due to his official acts as such.
